SE 20TH NEIGHBORHOOD SEWER PROJECT

 

UPDATE FEBRUARY 20, 2007 - SE 20th NSP PROJECT STOPPED

The proposed sewer on SE 20th Street (see figure) was being considered under the District's Neighborhood Sewer Program (NSP). In an NSP-funded project, at least 50% of the properties (by area and by share of the total project cost) within the boundary of the NSP project area must execute a Commitment Agreement to pay for their share of the sewer and agree to connect to the sewer immediately after it has been constructed. Those not connecting to the sewer as part of the NSP project would pay for their share when they connect to the sewer system in the future.

At the Board of Commissioners' meeting on February 20, 2007, the Board reviewed the number of signed Commitment Agreements that the District had received since mid January 2007 for the SE 20th Neighborhood Sewer Project. Since only 25% of the properties had executed Commitment Agreements, the Board voted to stop the SE 20th Neighorhood Sewer Program project at this time. The project may be reconsidered at some point in the future if there seems to be sufficient neighborhood support. The adjacent downstream Critical Link Project linking the 228th Sewer to SE 20th is still proceeding at this time.

The District wants to thank all of the property owners for their participation in this project. Your attendance at all of the evening meetings and your candid input - both supporting and opposing the project - was critical in ensuring that the Neighborhood Sewer Program addressed the community's needs and concerns.

 

UPDATE FEBRUARY 12, 2007

The proposed sewer on SE 20th Street (see figure) is being designed under the District's Neighborhood Sewer Program (NSP). In an NSP-funded project, at least 50% of the properties within the boundary of the NSP project area must execute a Commitment Agreement to pay for their share of the sewer and agree to connect to the sewer immediately after it has been constructed. Those not connecting to the sewer as part of the NSP project would pay for their share when they connect to the sewer system in the future.

A public meeting was held at the District's office on January 16, 2007 to discuss the design of the sewer on SE 20th Street, the process associated with the NSP program, the costs of sewer connection for each property within the project area, and the terms of the Commitment Agreement to pay for and connect to the sewer. This meeting, which was originally scheduled for January 11 but postponed due to snow, was attended by about ½ of the owners of property within the project boundary. Information packets, including the Commitment Agreement to be signed, were distributed to the property owners at the meeting. Packets for those property owners not at the meeting were mailed by certified mail. To date, it appears that most of the certified packets have been received by the property owners.

SE 20th Street is heavily used during the school year by school buses, parents, and students, as well as by the general public as a major east-west arterial. To avoid the impact to the school traffic, the SE 20th sewer is proposed to be constructed during July and August, when school buses are not running. Meeting this construction schedule means that the District must complete the design and secure a contractor during Spring 2007. Before the District can complete the design, it needs to know that there is sufficient public support (in the form of signed Commitment Agreements) for the project to go forward. Therefore, the District requested that the signed Commitment Agreements be returned to the District by Wednesday, January 31, 2007. On Monday, February 5, District staff reported to the Board of Commissioners that it had received Commitment Agreements from only 25% of the property owners. In response to requests from several property owners in attendance at the meeting for more time to consider the project, the Board granted an extension until Tuesday, February 20, 2007 for property owners to submit the signed Commitment Agreements to the District. The Board will evaluate the responses at their Board meeting on Tuesday, February 20, 2007 - the meeting begins at 3:00 p.m. Note that the regularly-scheduled meeting date has been moved from Monday to Tuesday due to the Presidents Day holiday. The public is invited to attend.

UPDATE MAY 2, 2006

Project Description
Extension of sewer from 228th Avenue SE near Discovery Elementary School westward then northward to SE 20th Street, then along SE 20th Street to 223rd Avenue SE (figure). Project is currently under design. Construction anticipated mid-2007 to late 2007.

Background
In 2003, property owners along the north shore of Pine Lake approached the District about forming a sewer Utility Local Improvement District (ULID) to extend sewer service from 228th westward along SE 21st and 227th and then along SE 20th to 223rd Avenue SE. A sewer ULID is a method by which property owners within a defined area sign petitions to request that the District design and construct a sewer system to serve the properties. The District requires that at least 60% of the property owners (by area) within the project boundary sign the petition. Once the ULID is formed, all property owners within the project boundary are assessed for the cost of the sewer system. The assessment can be paid off over a 15-year period.

The property owners circulated 2 questionnaires and held 2 public meetings to promote the idea of extending sewer service through the ULID method. However, there was insufficient support (less than 60% by area) to form a ULID. Since that time, the property owners have continued to meet with the District to explore other potential methods for sewer extension. Each of these methods is described below.

  • Developer Extension Agreement. Method by which one or more property owners agree to be responsible for the design and construction of the sewer system. The property owner(s) sign an agreement with the District to construct the sewer according to District standards. This method likely would require a large consortium of property owners to be economically feasible.
  • Neighborhood Sewer Program (NSP). Method by which property owners within a defined project boundary can have sewer extended without requiring all property owners within the project boundary to participate financially at the time of construction (property owners pay only when they connect to sewer). Upon receipt of signed connection agreements from at least 50% of the property owners (by area) to pay for and connect to the sewer once it is constructed, District proceeds with the design and construction of the sewer on behalf of the neighborhood. District bears the cost of the remainder of the project, recouping those costs as future property owners in the area connect.
  • District Capital Improvement Project. Project where the District is responsible for the design and construction of a sewer that provides service to an entire sewer basin or subbasin. Note that a portion of the proposed project is shown as a “Critical Link” in the District’s Wastewater Comprehensive Plan. A Critical Link is a capital improvement project that may include above-normal costs due to stream or road crossings, sections of deep sewer, difficult easement acquisition, sensitive area mitigation or other issues.
  • District-declared sewer ULID. This method is used if there is an overriding public need for the sewer system, such as a health emergency due to Pine Lake contamination. The District is not aware of any studies to indicate that this situation exists.

Representatives of the property owners supporting the sewer extension met with the District’s Planning/Operations/Engineering Subcommittee in December 2005 to discuss how to provide sewer service to those property owners who want it without financially burdening those who do not currently want it. The Subcommittee recommended to the Board of Commissioners a two-phase project: the first phase would include the District’s designated Critical Link between 228th and SE 20th to built as a District Capital Improvement Project, and the second phase would include the segment along SE 20th, which would require at least 50% of the property owners (by area) along the SE 20th route to support the project through the Neighborhood Sewer Program. Following discussions with the Board of Commissioners in January and February 2006, the portion of the sewer between 228th and SE 20th Street was designated as a high-priority critical link, enabling it to move forward to design and construction.

On May 1, 2006, the Board approved a design contract with Gray and Osborne Consulting Engineers to prepare designs for the Critical Link sewer and for the Neighborhood Sewer Project sewer. G&O’s work will include: surveying, design, permitting assistance, geotechnical explorations, wetlands/sensitive areas evaluations, assistance with easement appraisal and acquisition, construction cost estimating, and services during construction.

Anticipated Project Schedule  
Summer/early fall 2006 Prepare design of the two project phases (Critical Link portion and Neighborhood Sewer Project [NSP] portion)
October 2006 Prepare construction cost estimate based on 80% design
November 2006 District sends letter to each property owner along SE 20th within the boundaries of the NSP with estimated sewer connection costs
December 2006 - January 2007 District receives signed connection agreements from property owners
February - March 2007 If at least 50% of property owners (by area) return signed connection agreements, project will be publicly bid for construction in 2007
Summer/early fall 2007 Construction of both phases (Critical Link and NSP)

Future Updates
As the design of the project progresses, the District will provide periodic updates on this website. Topics will include potential traffic impacts during construction, coordination with the City of Sammamish for pedestrian improvements, explanation of the Neighborhood Sewer Program, and other topics of interest.

RE: Northeast Pine Lake, SE 21st/SE 20th Sewer Extension


Dear Property Owner:

Thank you to the many people who attended our informational meeting on the proposed Northeast Pine Lake, SE 21st/ SE 20th Sewer Extension project, and provided such significant feedback. It was truly a pleasure to have diverse viewpoints expressed in a candid yet neighborly manner.

There appears to be sufficient interest to warrant further investigation of how sewer service could be provided to the area. The District will be conducting this investigation over the next couple of months, and may be contacting some of you to obtain additional information.
